RULES OF PROCEDURE
FOR THE ORGANIZATION AND OPERATION OF THE MUNICIPAL ADMINISTRATION
IN THE MUNICIPALITY OF DOBRICH
CHAPTER I
GENERAL PROVISIONS
Art. 1. These Rules of Procedure define the organization of the municipal administration in the Municipality of Dobrich, the names and number of directorates in the general and specialized administration, the units directly subordinate to the Mayor, and their functions.
Art. 2. The Rules aim to ensure effective activity of the executive power in accordance with the Constitution of the Republic of Bulgaria, the European Charter of Local Self-Government, the Local Self-Government and Local Administration Act (LSGLAA), and the laws of the country.
Art. 3. In performing its activity, the municipal administration is guided by the following basic principles:

Art. 4. The administration carries out its activity in the interest of society and in compliance with the Constitution and other normative acts.
Art. 5. (supp., Order No. 688/21.06.2018) The municipal administration operates in compliance with the requirements of the Personal Data Protection Act (PDPA), Regulation (EU) 2016/679 on data protection, the Classified Information Protection Act (CIPA), and the Access to Public Information Act (APIA).
CHAPTER II
STRUCTURE OF THE MUNICIPAL ADMINISTRATION
Art. 6. The Municipal Council approves the overall number of staff and the structure of the municipal administration.
Art. 7.
(1) According to the distribution of activities it performs, the municipal administration is general and specialized.
(2) The general administration provides technical support for the activity of the Mayor, the specialized administration, and administrative services for citizens and legal entities.
(3) The specialized administration includes the directorates that support and ensure the exercise of the Mayor’s powers.

(1) The general administration is organized into one sector and two directorates with the following departments:

Units directly subordinate to the Mayor are the “Internal Audit” unit and the “Chancellery and Administrative Services” department.

The “Municipal Council Secretariat” unit is directly subordinate to the Chairperson of the Municipal Council and is part of the municipal administration structure. Its employees are appointed and dismissed by the Mayor upon proposal of the Municipal Council Chairperson.
Art. 9.
(1) The Mayor approves the staffing schedule of the municipal administration in accordance with the structure and total number approved by the Municipal Council.
(2) The employment of staff under civil-service or labor contracts is carried out by the Mayor under the terms and procedure of the Civil Servants Act and the Labour Code.
Art. 10. In addition to the functions set out in these Rules, municipal employees perform other tasks and are accountable to their direct supervisor for the performance of their duties in accordance with their job descriptions.
Art. 11.
(1) Directors and heads of departments plan, manage, organize, coordinate, control, report on, and bear responsibility for the activity and tasks assigned to them.
(2) Municipal employees are not obliged to execute unlawful acts and orders of superior bodies or officials.
(3) Municipal employees are not obliged to execute an unlawful order issued in the established manner when it clearly contains a violation for them.
CHAPTER III
POSITIONS IN THE MUNICIPAL ADMINISTRATION
Art. 12. A position in the municipal administration is a legally defined post occupied under a civil-service or labor relationship based on specific requirements and criteria; it is linked to a particular type of activity and is expressed in a system of functions, tasks, and obligations approved by a job description.
Art. 13. The work of the municipal administration is carried out by:

Civil servants;
-
Persons employed under labor contracts.
Art. 14.
(1) Positions in the municipal administration are: managerial, expert, and technical.
(2) Managerial positions are filled by civil servants.
(3) The positions of chief accountant, chief architect, and legal counsel are filled by civil servants.
(4) Expert positions may be filled by civil servants or by persons under labor contracts.
(5) Technical positions are filled only by persons under labor contracts.
Art. 15. Deputy Mayors and persons performing technical functions in the administration are not civil servants within the meaning of the Civil Servants Act.
Art. 16. In their work, municipal employees are guided by the European Code of Good Administrative Behaviour, the Code of Conduct for Employees in the State Administration, the Client Charter, and the Ethics Code of Employees of Dobrich Municipality.
CHAPTER IV
MAYOR, DEPUTY MAYORS, MUNICIPAL SECRETARY
Section I
MAYOR
Art. 17.
(1) The Mayor is a single-person body of executive power.
(2) The Mayor is the primary authorizing officer of the municipal budget.
(3) In his/her activity, the Mayor is guided by the law, the acts of the Municipal Council, and the decisions of the population.
Art. 18.
(1) The Mayor appoints Deputy Mayors, in accordance with the staff number and structure approved by the Municipal Council, and determines their powers.
(2) The Mayor designates by order a Deputy Mayor to substitute him/her in case of absence from the municipality.
(3) The Mayor may authorize Deputy Mayors to perform his/her functions where provided by law.
(4) A Deputy Mayor may be dismissed without notice by order of the Mayor.
Art. 19. The Mayor, Deputy Mayors, and the Secretary may not engage in commercial activity within the meaning of the Commerce Act, nor be controllers, managers or procurators in commercial companies, commercial agents, representatives or intermediaries, trustees in bankruptcy, liquidators, or participate in supervisory, management, or control bodies of commercial companies and cooperatives during their mandate.
Section II
POWERS OF THE MAYOR
Art. 20. The Mayor’s powers are determined by law.
Art. 21.
(1) The Mayor:
-
Manages the entire executive activity of the municipality;
-
Directs and coordinates the activity of specialized executive bodies;
-
Appoints and dismisses Deputy Mayors, heads of budget-funded units, heads and employees of the municipal administration; imposes disciplinary sanctions provided by law;
-
Is responsible for public order and issues written orders mandatory for heads of the respective police services;
-
Organizes the implementation of the municipal budget;
-
Organizes the implementation of long-term programmes;
-
Organizes the implementation of Municipal Council acts and submits a report twice a year;
-
Organizes the implementation of tasks arising from laws and acts of the President and Council of Ministers;
-
Maintains relations with political parties, NGOs and movements, and other local-government bodies in Bulgaria and abroad;
-
Supports condominium associations under the Condominium Management Act;
-
Chairs the Security Council;
-
Assigns or authorizes the drafting/amending of spatial plans and approves certain plans under the Spatial Development Act, and organizes their implementation;
-
Performs functions of civil-status officer and guardianship body; may delegate these functions in writing;
-
Determines addresses where address registration may be performed;
-
Performs or designates officials to perform address registrations;
-
Represents the Municipality before individuals, legal entities and courts;
-
Ensures organizational and technical support to the Municipal Council and participates in its sessions with an advisory vote;
-
Approves these Rules of Procedure;
-
Sends administrative acts and contracts issued in implementation of Council acts within three days;
-
Exercises employer powers under the Labour Code, Civil Servants Act and secondary legislation;
-
Develops partnerships with Bulgarian and foreign municipalities and NGOs;
-
Acts as administrative-penalty authority;
-
Proposes wage-fund amounts; may propose municipal symbols and honors, honorary citizenship/titles, and declare a local holiday/non-working day;
-
Establishes commissions and councils to support the administration;
-
Presents a management programme within three months after taking oath; reports annually by 31 January;
-
Ensures joint activity of the Municipal Council and the administration;
-
Ensures effective organization of administrative work, approving internal labor rules in coordination with unions;
-
Organizes civil-protection activity in disasters and accidents;
-
Exercises other powers granted by laws and regulations.
(2) In exercising these powers, the Mayor issues orders under Art. 44(2) of the LSGLAA.
(3) In cases provided by law, the Mayor also performs functions delegated by central state bodies.
Section III
POWERS OF DEPUTY MAYORS
Art. 22. (amend., Order No. 444/03.04.2025)
There are 4 (four) Deputy Mayors:

Deputy Mayor “Strategic Development and Economy”

Art. 23. Deputy Mayors:

Assist the Mayor within their respective directorates;
-
Substitute the Mayor when designated by order;
-
Manage, coordinate, and are responsible for directorates and departments within their portfolios.

The Deputy Mayor “Finance and Municipal Property” performs the functions listed in the Bulgarian text (management of Budget and Finance, Local Taxes and Fees, Municipal Property, budget process, revenues, municipal assets, investments, privatization/concessions, EU funds control, housing policy, etc.).

The Deputy Mayor “Spatial Planning” performs the functions listed in the Bulgarian text (management of SPIE directorate, coordination, spatial plans control, capital-expenditure programme, infrastructure, environment, commissions, etc.).

The Deputy Mayor “Strategic Development and Economy” performs the functions listed in the Bulgarian text (management of SDPE directorate, economic development, municipal development plan, tourism programme, civic initiatives, projects/EU funds, business relations, municipal companies, sports calendar, etc.).
Art. 27.
The Deputy Mayor “Humanitarian Activities” performs the functions listed in the Bulgarian text (management of Humanitarian Activities directorate, education, youth, culture, social policy, health in schools/kindergartens, social services councils and commissions, etc.).
Section IV
POWERS OF THE MUNICIPAL SECRETARY
Art. 28. The Mayor appoints a Municipal Secretary on an open-ended term.
Art. 29.
(1) The Secretary organizes the activity of the municipal administration and is responsible for the areas listed in the Bulgarian text (administration operation, records management and archive, civil registration and services, publication of acts, handling complaints/signals, voter lists, HR management, training, ethics compliance, administrative services control, annual report on the administration, elections/referenda organization, disaster-protection plan and training, drug prevention center support, cooperation with the National Ombudsman, etc.).
(2) The Secretary also performs other functions assigned by the Mayor, by law or other normative acts.
CHAPTER V
FUNCTIONS AND WORK ORGANIZATION OF THE MUNICIPAL ADMINISTRATION
Section I
GENERAL ADMINISTRATION

The general administration consists of two directorates and one sector:

Directorate “Administrative-Legal, Information and Technical Services” (ALITS)

Directorate “Budget and Finance” (BF)

Sector “Human Resources Management”.

ALITS consists of three departments:

ALITS performs the functions listed in the Bulgarian text (planning/coordination/control of departments; development of administrative services and e-government; participation in projects; organization of public procurement procedures; reporting; preparation for elections/referenda, etc.).
Art. 33. (amend., Order No. 444/03.04.2025)
The “Chancellery and Administrative Services” Department is directly subordinate to the Mayor and performs the functions listed in the Bulgarian text (contacts and protocol, databases, projects, memberships, media policy, social media, ICT systems and security, support to Council, working environment, elections, execution-control system, website, logistics, hygiene/transport, mobilization/defense, classified info protection, disaster response, etc.).
Art. 34.
The “Services and Information Center” Department performs the functions listed in the Bulgarian text (front-office services, inter-department coordination, records and workflow, handling requests/complaints and access to public info, reception days, e-services, electronic archives/registers, etc.).

The “Legal Services and Public Procurement” Department performs the tasks and legal functions listed in the Bulgarian text (annual procurement plan, documentation/contracts, commissions, CAIS EPP procedures, buyer profile, procurement files archive, legal opinions/representation, drafting acts and contracts, court registers, cases on overdue local taxes/fees, etc.).
Art. 35a. (amend., Order No. 444/03.04.2025)
The “Human Resources Management” Sector performs the functions listed in the Bulgarian text (HR legality/efficiency, analyses, personnel files and registers, staffing schedules, budget inputs, job descriptions, recruitment/selection, competitions, evaluations, training plans and register, internships, consultations, salary rules, website personnel module, anti-corruption declarations register, retirement/rehabilitation documentation, support to secondary budget holders, etc.).
Art. 36. (amend., Order No. 444/03.04.2025)
The “Budget and Finance” Directorate performs the functions listed in the Bulgarian text (budget planning/execution/control/reporting; preliminary financial control; accounting and payroll; management of assets and inventories; and, new in 2025, organizing the introduction of the euro in compliance with the Euro Adoption Act, etc.).
Section II
SPECIALIZED ADMINISTRATION
Art. 37. (amend., Order No. 444/03.04.2025)
The specialized administration consists of six directorates:

Art. 38 – 56.
The directorates, departments, and units perform the detailed functions described in the Bulgarian text, including:

Administration and collection of local taxes/fees and enforcement (Art. 38).

Management, acquisition, disposal and leasing of municipal property, privatization, concessions, housing issues, etc. (Art. 39).
-
Spatial planning, construction control, infrastructure, environment, green system, sanitation, etc., and the Chief Architect’s role (Arts. 40–42).
-
Strategic development, projects/EU funding, economic development, trade, tourism, transport, sports, business relations, civic initiatives (Arts. 43–47).
-
Education, culture, healthcare and social policies, social services planning and control, child protection, reproductive health fund support, etc. (Arts. 48–51).
-
Civil registration, population registers, elections and voter lists maintenance (Art. 53).
-
Internal Audit unit and its independence, planning, audits, recommendations and annual reporting (Arts. 54–55).
-
Municipal Council Secretariat functions (Art. 56).
Section III
WORK ORGANIZATION
Art. 57. The work organization is carried out according to these Rules and other internal rules, procedures, instructions and systems approved by the Mayor.
Art. 58.
(1) Working time is 8 hours per day, 40 hours per week (five-day work week).
(2) Working hours are from 8:00 a.m. to 5:00 p.m., with a lunch break from 12:00 p.m. to 1:00 p.m.
(3) Administrative service units work from 8:00 a.m. to 5:00 p.m.; staff take a 60-minute lunch break between 11:00 a.m. and 2:00 p.m.
Art. 59.
(1) Where necessary, employees in certain units may perform duties beyond the hours in Art. 58(2)–(3), without violating daily/weekly rest.
(2) The procedure for work outside normal hours and for determining additional leave is set by the Mayor.
FINAL PROVISIONS
§ 1. These Rules may be amended and/or supplemented by order of the Mayor in case of changes in the structure or functions of the administration or legislative amendments.
§ 2. These Rules were approved by Order No. 419/08.04.2016, amended and supplemented by Orders No. 1031/30.08.2017, No. 688/21.06.2018, and No. 444/03.04.2025, and repeal the previous Rules approved by Order No. 382/26.03.2012.
§ 3. Control over the implementation of these Rules is assigned to the Municipal Secretary.
§ 4. These Rules are approved on the basis of Art. 44(1)(17) of the LSGLAA.
§ 5. (Order No. 1031/30.08.2017) An integral part of the Rules is Annex No. 1 – the structure and total staff number approved by Decision No. 20-5/30.05.2017 of the Municipal Council.
§ 6. (amend., Order No. 444/03.04.2025) An integral part of the Rules is Annex No. 1 – the new administrative structure approved by Decision No. 3-4/19.12.2023 of the Municipal Council.
