on outdoor trading of flowers at the parking lot in front of the Cemetery Park

LOCATION AND APPEARANCE
Outdoor commercial activity shall be carried out at the parking lot in front of the Cemetery Park, in accordance with a placement scheme approved by the Chief Architect of the city of Dobrich, on sites each measuring 2 sq. m.
PERMITTED RANGE OF GOODS
Flowers – cut flowers, bouquets, artificial and dried flowers, wreaths, candles.
PROCEDURE FOR PARTICIPATION AND OCCUPATION OF SITES
The sites covered by this Regulation are those indicated in the scheme approved by the Chief Architect.
Participation is open to sole traders, legal entities, and agricultural producers who have not participated in previous lottery procedures during the current year, if such have been conducted. Each participant may apply for only one site.
Participants are required to comply with Bulgarian legislation and all regulations applicable to the commercial activity carried out.
Interested parties shall submit an application using the standard form (Appendix No. 1) at the registry office of the Municipal Enterprise “Funeral Services House” – Dobrich, 1 Adriana Budevska Street, from 08:00 on 16 January 2026 until 12:00 on 27 January 2026. Applications shall be submitted in person or by an expressly authorized representative, with notarized power of attorney.
In the application for issuing an outdoor trading permit (Appendix No. 1), the applicant shall specify the desired frequency (for a full month or for specific days) and the period of use of the site.
In cases where the person intends to continue the commercial activity and already holds a previously issued permit, they shall submit an application for extension of its validity (Appendix No. 2) at least 10 days prior to the expiry of the specified period, indicating the period and frequency of use of the site.
A person wishing to change the frequency of use (for a full month or for specific days) of the site selected during the lottery may do so within 10 days prior to the expiry of the period specified in their existing permit. The applicant shall state this intention and specify the new desired period when submitting the application.
If, after the expiry of the payment deadline for the sites subject to the present lottery procedure, there are unoccupied sites, they shall be made available for selection by interested persons in the order of submission of applications registered at the enterprise registry. Occupation shall take place on the first working day of the month following submission, upon payment of the applicable fee.
If fewer than three applications are submitted for a specific lottery procedure, the sites shall be allocated for selection by interested persons in the order of submission of their applications registered at the enterprise registry, with occupation taking place on the first working day of the month following submission, upon payment of the applicable fee.
Permits shall be refused to traders whose documents do not meet the requirements or whose range of goods does not correspond to that specified in Section III. The refusal shall be justified by a written statement within seven (7) days of submission of the request.
The following documents shall be attached to the application for issuance of a permit (Appendix No. 1):

Declaration (standard form) of consent with the conditions of the present Regulation for outdoor trading of flowers on the territory of the Cemetery Park;

Registration and survey card for agricultural producers, certified for the current year – certified copy (original presented for verification);

Where the application is not submitted by the applicant personally – a copy of the power of attorney with notarized signature (original presented for verification);

Other documents relied upon by the applicant.
The sites under the scheme shall be allocated by lottery on 28 January 2026 at 10:00 a.m. in the hall of the Municipal Enterprise “Funeral Services House” – Dobrich, 1 Adriana Budevska Street, based on the submitted applications. Applicants shall attend in person or through an authorized representative with notarized power of attorney.
The names of all applicants shall be written on paper and placed in a transparent container in a visible location. Those present shall choose a person who will draw the lottery determining the order of site selection.
The selected participant or their authorized representative (copy of power of attorney provided, original for verification) shall appear before the commission, select a site according to the placement scheme, and record the selection in their application for permit issuance.
A protocol shall be drawn up for the lottery, containing: the name of the person who conducted the draw, a list with the order number, the full names of the participants, the selected sites, and the participant’s signature. The protocol shall be signed by the commission and the person conducting the lottery.
If a selected participant is not present at the time, the paper bearing their name shall be placed in a separate transparent container. After completion of the main draw, an additional draw shall be conducted immediately for absent participants. If a participant fails to appear for the additional draw as well, they shall be deemed to have waived their right to participate in the procedure. This circumstance shall be recorded in the protocol.
Permits for outdoor trading shall be issued by the Director of the Municipal Enterprise “Funeral Services House” or an authorized official, after payment of the due fee at the cashier’s office of the Cemetery Park administrative building. The fee is determined pursuant to Article 22, paragraph 1 of the Ordinance on the Determination and Administration of Local Fees and Service Prices on the territory of Dobrich Municipality, namely: EUR 0.51 per sq. m. (BGN 1.00 per sq. m.) per day or EUR 11.50 per sq. m. (BGN 22.50 per sq. m.) per month.
Permits issued following the lottery procedure may be collected on 29 January 2026 at the Cemetery Park Administration – Dobrich, after payment of the due fee, and shall be valid for the specified period and frequency.
Permits issued on the basis of an application for extension (Appendix No. 2) may be collected between the 20th and 25th day of the preceding month, after payment of the due fee, and shall be valid for the specified period and frequency.
If no application for extension is submitted or the due fee is not paid for the relevant period, the site allocated under this Regulation shall be deemed vacated.
Occupation of the sites shall take place in the presence of employees of the Municipal Enterprise “Funeral Services House” at 10:00 a.m. on 30 January 2026. After that date, prior notification to the Cemetery Park Administration is required.
V. Mandatory Conditions for Traders
Traders are required to be familiar with and comply with their obligations under the applicable national legislation, as well as the Ordinance on Commercial Activity on the Territory of Dobrich Municipality, which contains a separate section regulating outdoor trading on municipal property, namely:
a) not to unlawfully increase the area granted under the permit;
b) not to change the site granted under the permit;
c) not to damage the street pavement;
d) to use municipal waste containers, including containers for separate waste collection, for disposal of packaging and other waste generated by their activity.
Outdoor trading is prohibited:
a) without a permit issued by the Municipality and without payment of the due fee;
b) with goods different from those authorized;
c) in green areas;
d) with goods offered directly from vehicles, in the form of itinerant trading.
Compliance with this Regulation and with the conditions of issued outdoor trading permits shall be monitored by employees of the Municipal Enterprise “Funeral Services House” – Dobrich.
VI. Other Conditions
An issued permit for outdoor commercial activity may be revoked by order of the Mayor of Dobrich Municipality if the site is not used for its intended purpose, is not used by the person to whom it was granted, or where public needs so require.
A trader may terminate their activity before the expiry of the permit period, in which case they must notify the administration of the Municipal Enterprise “Funeral Services House” in writing and return the issued permit. The fee paid for the current month shall not be refunded, and the site shall be deemed vacant.
